Terms of Service

Henceforth Dragonstorm Studios will be referred to as “The Artist” and the commissioner will be referred to as “The Client”. The Artwork will henceforth refer to propwork and artwork completed on commission unless noted otherwise. The Work will henceforth refer to images that may be produced through the use of machine learning or derived technologies.** These terms are drawn up for private commissions – for commercial use please contact The Artist to draw up an appropriate contract.

 

0. Addendums

NEW TERMS ADDED MARCH 20, 2023
The following terms are defined by two asterisks (**) and apply to all clients, whether the artwork was completed before the aforementioned date or after.

1. General

a) By commissioning The Artist, The Client accepts these terms of service.

b) The Artist has the right to refuse a commission without explanation.

c) The Artist has the right to cancel a commission. See Section 2.c for payment and refund information.

 

2.  Payment **

a) Payments must be paid through INTERAC E-Transfer or Paypal. All prices are in CAD. The Client must notify The Artist of their payment address to begin the invoicing process.

b) Payment must be received before The Artist will begin The Artwork, unless alternate arrangements have been stipulated. Setting up thumbnails does not constitute work on The Artwork. Commissions under $80 CAD must be paid in full up front. Commissions greater than $80 CAD may be made in flexible increments at stages of completion. Please contact The Artist to arrange a payment system if desired.

c) The Artist retains the right to cancel the commission if The Artist deems The Client to be rude and/or offensive, or for personal reasons. If this is the case a refund of ___ would be issued as follows:

– 100% if the work has not yet begun.

– 50% if the work has begun but is only in the beginning stages. (Up until a completed sketch)

– 0% in any other scenario.


The Artist
may choose to provide a refund beyond these stipulations, depending on the nature behind the refund.

 

3. Image Rights

a) The Artist has the right to upload and publish the artwork to third-party websites (e.g Deviantart, Furaffinity, etc.) and personal galleries.

b) The Artist has the right to resell and make profit off of The Artwork. The Artist also has the right to resell the original piece of The Artwork unless it is purchased by The Client.

c) The Client may repost the image of the artwork publicly as long as visible credit is given to The Artist.

d) Commercial rights may be purchased for an additional fee prior to, or upon completion of The Artwork

e) The Client may resell The Artwork’s original piece if it is purchased

f) The Client is permitted to use The Artwork for non-profit purposes and personal use, as long   as visible credit is given to The Artist. The Artist’s signature may not be altered or removed.

g) The Artist retains the right to charge The Client 500% of the original fee per piece for the rights to change or adjust The Artwork through the use of machine learning or derived technologies, or create derivatives of The Artwork through the use of machine learning or derived technologies. The Artist will retain the right to resell and profit off of The Work that is altered or created in this manner, and visible credit must be given to The Artist as the original creator of The Work that is altered or created in this manner.** (See 0. 4. Deadlines

  • The Artist has the right to prioritize commissions based on set deadlines.
  • The Artist has the right to refuse a commission if The Artist is aware that a commission may not be completed on time.
  • If The Client requires a deadline for completed artwork, please contact The Artist to arrange this.

 

5. Notes

  1. The Artist will draw many things, however there is some material that will not be drawn under any circumstances:
  • Excessive violence and/or gore
  • Fetishistic material
  • Anything that is deemed ‘Not Safe for Work’ (NSFW) by The Artist*
  • Anything that The Artist fees morally uncomfortable in drawing

 

2. The Artist may draw:

  • Artistic nudity, determined acceptable on a case by case basis.*

 

*It is encouraged that The Client contact The Artist to assess if the potential commission is NSFW. The Artist will strive to answer all questions in a timely manner.
